Processing times for I-765 in 2026: asylum, AOS, OPT, H-4. How to check status, automatic 540-day extension.

Introduction

EAD (Employment Authorization Document) allows individuals without a Green Card to work legally in the USA. You apply using form I-765. The waiting time depends on the category and USCIS office.

2026 Times (approximate)

Asylum (c)(8) – initial application

  • Required time after I-589: 150 days (clock)
  • USCIS time: 2-8 months
  • Total from fleeing to legal work: 7-13 months
  • EAD valid for 2 years; automatic extension of 540 days upon renewal

Asylum (c)(8) – renewal

  • Apply 180 days before expiration
  • Time: 4-10 months
  • Auto-extension of 540 days from expiration (from 2024)

Adjustment of Status (c)(9) – pending Green Card

  • Time: 6-12 months
  • Valid for 2 years or until decision

H-4 (spouse of H-1B)

  • Requires H-1B with approved I-140
  • Time: 4-10 months

OPT (F-1 students)

  • Time: 2-5 months
  • STEM extension: +24 months

U-Visa pending

  • Time: 12-36 months (long queue)

VAWA

  • Time: 12-24 months

  • You will receive a range of days

Case Status Online

Extended waiting – what to do

  • Service Request – if "outside normal processing time" has passed
  • Congressional inquiry – a congressman has a channel to USCIS (find on house.gov)
  • USCIS Ombudsman – form DHS-7001
  • Mandamus lawsuit – federal lawsuit; costly (3-5k USD), but effective in 6-12 weeks

540-day rule (automatic extension)

  • From 2024 – renewal submitted before expiration = auto-extension of 540 days
  • Employer can continue employment
  • Most categories (c-8, c-9, c-26) – check uscis.gov/eadautoextend

Costs of I-765

  • Initial permit (asylum c-8): free
  • Renewal (c-8): 410 USD
  • OPT (c-3): 410 USD
  • AOS together with I-485: free
  • Fee waiver: I-912 for low-income individuals

Common Mistakes

  • Applying too early (before 150 days of asylum) – rejection
  • Lack of biometrics – prevents decision
  • Lack of current address (report AR-11)
  • Working before EAD = status violation
  • Delaying renewal – loss of 540-day grace

Working while waiting

  • No legal work without EAD
  • Working without EAD = status violation, risk of deportation
  • Volunteering (without pay) – allowed
