1. Introduction

Welcome to informacja.com! Our portal is a place for the Polish community where you can find local news, classifieds, events, and a directory of Polish businesses.

By using informacja.com, you agree to these Terms of Service. If you do not agree with any of the provisions, please do not use our services.

informacja.com is a private portal and we reserve the right to moderate content and manage user access.

2. Definitions

• Service - the informacja.com website including all subpages and functionalities
• User - any person using the Service
• Account - an individual user account in the Service
• Classified - content posted by a User in the classifieds section
• Business - an entry in the business directory (Yellow Pages)
• Administrator - the owner and operator of informacja.com

3. General Rules

By using informacja.com, you agree to:

• Comply with applicable law (federal, state, and local)
• Respect the rights of other users
• Not post content that is illegal or contrary to good morals
• Provide accurate contact information
• Not abuse the Service's functionality

Since minors also use our service, please do not post vulgar, offensive, or inappropriate content for all age groups.

4. User Account

To use the full functionality of the service (posting classifieds, managing a business), you must create an account.

Registration

• Users must be at least 18 years old or have parental consent
• A valid email address is required
• One person may have only one account
• Creating accounts to circumvent restrictions or bans is prohibited

Account Security

• You are responsible for keeping your password secure
• Do not share login credentials with others
• If you suspect unauthorized access, change your password immediately and contact us

5. Posting Classifieds

General Rules

• Classifieds may be posted in Polish or English
• Each classified must include a valid phone number or email address
• Please do not repost the same classified more than once every 7 days
• Classifieds must be placed in the appropriate category

Duration

• Free classifieds are active for a set period (typically 30 days)
• Expired classifieds can be renewed
• Promoted classifieds have longer display times

Administrator Rights

The Administrator reserves the right to:

• Refuse to publish a classified without giving a reason
• Edit or shorten the content of a classified
• Move a classified to a different category
• Remove classifieds that violate these Terms

6. Business Directory

Adding a Business

• Business directory entries are intended for legally operating businesses
• Accurate business contact information is required
• One business may have only one entry (unless it has multiple locations)

Business Verification

• Businesses can go through a verification process to increase credibility
• Verification may include: phone confirmation, document verification, or QR code
• Verified businesses receive a verification badge

Reporting Issues

Users can report business listings that:

• No longer exist
• Contain incorrect information
• Are duplicates of other entries
• Violate these Terms

7. Prohibited Content

The following content is prohibited on informacja.com:

• Content that violates federal, state, or local law
• Pornographic or sexually explicit material
• Content promoting violence, hatred, or discrimination
• Offers to sell illegal substances (drugs, prescription medications)
• Firearms and ammunition (except from licensed dealers)
• Stolen items or items of questionable origin
• Scams, pyramid schemes, "get rich quick" schemes
• False or misleading information
• Spam, mass advertising, or auto-generated content
• Personal data of others without their consent
• Content infringing copyrights or trademarks
• Vulgar, offensive, or harassing content
• Job offers requiring upfront payment from candidates
• Fake reviews or testimonials

8. Moderation

The Administrator actively moderates content to ensure safety and quality.

Moderation Actions

The Administrator may:

• Remove or edit content that violates these Terms
• Temporarily or permanently ban user accounts
• Restrict functionality available to a user
• Report information to law enforcement if a crime is suspected

Reporting Violations

Users can report content that violates these Terms by:

• Using the "Report" button on a classified or listing
• Contacting the Administrator by email

9. Payments

Some services are paid (e.g., promoted classifieds, premium business listings).

Payment Terms

• Prices are listed in US Dollars (USD)
• Payment is required upfront before service activation
• We accept credit/debit cards, PayPal, Apple Pay, Google Pay
• Invoices are available upon request

Refunds

• Service fees are generally non-refundable
• In case of technical error preventing service use, a full refund is available
• Removal of a classified due to Terms violation does not entitle you to a refund

10. Liability

Administrator Liability

• The Administrator is not responsible for the content of user classifieds and listings
• The Administrator is not a party to transactions between users
• The Administrator does not guarantee the accuracy of information provided by users
• The Service is provided "as is" without warranties

User Liability

• Users bear full responsibility for content they publish
• Users agree to compensate for damages caused to the Administrator or other users
• Transactions between users are conducted at their own risk

Limitation of Liability

To the maximum extent permitted by law, the Administrator shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages related to use of the Service, including:

• Lost profits, data, reputation, business opportunities
• Consequences of decisions based on information from the Service
• Consequences of errors or outdated content
• Consequences of using businesses listed in the directory
• Consequences of transactions with other users
• Consequences of technical interruptions, hacking attacks, system errors
• Actions of other users

Liability cap

To the maximum extent permitted by law, the Administrator's total aggregate liability to any user for all claims arising out of or related to use of the Service — regardless of legal theory (contract, tort, warranty, statute) — shall not exceed the greater of:

• (a) One hundred US Dollars ($100 USD), or
• (b) The total amount the user actually paid to the Administrator in the twelve (12) months preceding the event giving rise to the claim

This limit applies even if the Administrator has been advised of the possibility of such damages and even if any remedy provided in these Terms fails of its essential purpose.

11. Intellectual Property

Administrator Rights

• The name "informacja.com", logo, and site design are the property of the Administrator
• Copying, distributing, or modifying site elements without permission is prohibited
• Automated data collection from the site (scraping) is prohibited

User Content

• Users retain rights to content they publish
• By publishing content, users grant the Administrator a non-exclusive license to display and process it within the Service

Copyright Infringement (DMCA)

If you believe your copyright has been infringed, contact us with:

• Identification of the copyrighted work
• Location of the infringing content (URL)
• Your contact information
• A statement of good faith

12. Privacy

User privacy is our priority. Detailed information about personal data processing can be found in our Privacy Policy.

Key principles:

• We do not sell user data to third parties
• We do not display ads from external advertising networks
• Data is used only to provide Service functionality

13. Guides (Poradnik)

The Guides (Poradnik) section contains informational content on government, legal, tax, immigration, health, and other aspects of life for Poles abroad.

Posting in Guides

• Only authorized "Editors" appointed by the Administrator can publish guides
• Every guide is informational and educational only — does not constitute legal, tax, immigration, or medical advice
• Every guide includes a "Disclaimer" recommending consultation with a licensed professional
• Content may be automatically translated by artificial intelligence (OpenAI or similar services) from Polish to English — see Disclaimer
• The Polish version is the source (canonical) version

Prohibited content in Guides

• Illegal immigration advice (e.g., visa fraud, fake marriage, fake asylum)
• Posing as a licensed lawyer, doctor, tax advisor (see Community Guidelines)
• Guarantees like "100% Green Card" or similar dishonest declarations
• Content promoting scams, fraud, pyramid schemes
• Content infringing copyrights of other authors

Liability for guide content

The Administrator does not guarantee accuracy, currency, or completeness of guides. Laws change constantly, and content may be outdated when read. Full disclaimer of liability is in the Disclaimer.

14. Section 230 — Platform Protection from User Content

This section protects informacja.com from liability for user-generated content, in accordance with US law.

Pursuant to Section 230 of the Communications Decency Act (47 U.S.C. § 230), informacja.com is an "interactive computer service provider" and:

• Shall not be treated as the publisher of information provided by users (information in classifieds, business entries, events, comments, etc.)
• Is not liable for user content, even if such content is false, defamatory, infringing on rights of others, or illegal
• May, in good faith, restrict access to content deemed obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable — without losing Section 230 protection
• May (but is not required to) moderate content; absence of moderation of specific content does not constitute approval

Liability for user-generated content lies solely with those users. Claims regarding user content should be directed to those users, not to the Administrator.

15. Indemnification

By using informacja.com, the user agrees to defend, indemnify, and hold harmless the Administrator from any:

• Claims, lawsuits, legal proceedings
• Damages, penalties, court judgments
• Legal defense costs (including reasonable attorney's fees)
• Other costs and losses

...arising from:

• Content published by the user
• User's violation of these Terms, Community Guidelines, or other Service documents
• User's violation of applicable law
• User's violation of third-party rights (including intellectual property, privacy, personality rights)
• User's use of the Service inconsistent with its purpose

The Administrator reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and the user agrees to cooperate in defense of such claims.

16. Arbitration and Class Action Waiver

Mandatory arbitration

All disputes, claims, or controversies arising out of or related to:

• These Terms
• Use of informacja.com
• Content on the Service
• Transactions between users and the Administrator

...shall be resolved exclusively by binding individual arbitration, under the rules of the American Arbitration Association (AAA) or JAMS, in Queens County, State of New York, USA, or remotely.

Exceptions to arbitration (matters that may go to court):

• Small claims court matters (up to $10,000 in NY)
• Injunctive relief regarding intellectual property rights
• Criminal matters

Class action waiver

IMPORTANT — READ CAREFULLY:

• All claims must be brought individually, not as a class action or on behalf of a class
• The arbitrator MAY NOT consolidate claims of multiple parties
• The arbitrator MAY NOT conduct class arbitration
• The user waives the right to participate in class actions against the Administrator
• The user waives the right to a jury trial

Opt-out of arbitration

The user may opt out of arbitration by sending written notice to kontakt@informacja.com within 30 days of first use of the Service. The notice must include name, email address, and a clear statement of opt-out.

17. Governing Law and Jurisdiction

These Terms and all disputes arising from use of informacja.com are governed by:

• Substantive law of the State of New York, USA (excluding conflict-of-laws rules)
• Exclusive jurisdiction: state and federal courts in Queens County, State of New York, USA
• Exclusive venue: for matters requiring court proceedings (not covered by arbitration) — courts in Queens County, NY

By using the Service, the user consents to personal jurisdiction of courts in Queens County, NY, regardless of their place of residence.

If any part of these Terms is held invalid or unenforceable, remaining provisions retain full force. The class action waiver and arbitration clauses are severable — invalidity of one does not invalidate the other.

18. Changes to Terms

• The Administrator reserves the right to change these Terms at any time
• Users will be notified of significant changes (email, site notification)
• Continued use of the Service after changes constitutes acceptance of the new Terms
• If you do not agree with changes, you may delete your account
