The absence of a transfer after payday, a bounced check, unpaid hours, and deductions without clear explanations require organizing the facts. The most helpful approach is to calmly prepare a set: who employed you, where the work was performed, when the money was due, how many hours were worked, and how much was actually paid. This guide shows how to gather such material and find the appropriate federal or state procedure in New York, New Jersey, and Illinois.
Sources verified on October 27, 2026. This is general information, not an assessment of an individual claim. The scope of protection, deadlines, and the appropriate path depend on the state, type of work, employee status, and type of claim. Reporting to the agency does not guarantee recovery of funds.
What to Do First
- Record the date when the payment was due and check if the issue stems from an obvious accounting mistake.
- Secure your legally held pay stubs, messages, schedules, and payment history. Do not log into the employer's system without authorization.
- Create a summary of hours and payments separately for each workweek.
- Determine in which state the work was performed and which company was the actual employer.
- Check the appropriate procedure and deadline. A conversation with the boss should not lead to missing the deadline for filing a claim.
- If there were threats, termination, or reduction of hours after reporting the issue, also document this separate sequence of events.
First, Identify the Type of Problem
| Situation | What to Determine | Why It Matters |
|---|---|---|
| Not all wages were paid | Pay period, established rate, payment date | This is a basic point of comparison for the claim against payment |
| Paid for fewer hours | Actual work, breaks, preparation, training | Not every entry on the schedule reflects actual working time |
| No overtime | Application of regulations and number of hours in one week | Not every employee is covered by the same rule |
| Money was deducted | Reason, amount, documents, and consent if required | The legality of the deduction depends on the rules applicable to the case |
| Dispute over commission, bonus, or severance | Content of the contract, conditions for acquiring rights, and agency jurisdiction | Some official procedures have limitations for such claims |
| Client did not pay the invoice to the actual contractor | Status of the contractor and service agreement | This may be a contractual dispute, not a typical employee wage claim |
W-2, 1099, and Cash Do Not Resolve Everything
Simply labeling someone as an independent contractor, issuing a 1099 form, or signing a document with such a label does not automatically mean they are indeed an independent contractor. The Department of Labor emphasizes the importance of the actual relationship. Federal and state rules may differ, and federal classification is subject to regulatory changes, so we do not apply a single simplified test to all cases.
If the company assigned the work and presented you as a contractor, describe the facts: who set the schedule, provided tools, assigned tasks, and was responsible for payments. Do not alter the history to fit the form. Cash payments can also leave evidence: dated messages, envelopes, personal notes, and confirmations of actual payment.
Documents: Gather Evidence, Not Excess Files
NJDOL lists, among other things, pay stubs, hour summaries, checks, records of cash payments, and messages. The material is more useful when it contains dates, amounts, and direct information. You do not need every type of evidence to ask the agency for help.
| Folder | Contents | Good Editorial Practice |
|---|---|---|
| 01-employment | Offer, contract, rate agreements, company data | Keep the full document and the date received |
| 02-hours | Schedules, personal journal, work orders | Separate paid work from unpaid breaks and note uncertainties |
| 03-payments | Pay stubs, transfers, checks, envelopes | Distinguish gross and net amounts |
| 04-correspondence | Emails, texts, and responses regarding payment | Preserve context, sender, and date, not just a cut-out sentence |
| 05-report | Copy of the form, attachments, case number | Do not overwrite the sent version with later corrections |
Do not take confidential client data or medical documentation that you do not need for your own case. Recording conversations is subject to various rules depending on the location and circumstances; we do not advise secret recording as a universal method. The simplest approach is to keep a dated journal and confirm significant agreements in writing.
Timesheet and Calculation of Arrears
Download a blank timesheet in CSV. Record each day in a separate row: date, location, start, end, actual unpaid break, number of hours, established rate, and source of information. Memories supplemented over time should be marked as reconstructed, rather than presented as notes made on the same day.
DOL describes the rules of working time, including short breaks and meal periods. Do not mechanically deduct thirty minutes if you were actually performing duties during the "break." On the other hand, mere presence near the workplace does not always yield the same legal result. Record the reality and present it for evaluation.
Calculation Example: 45 Hours at $20
Assume a fictional employee subject to overtime, one week of work, a regular rate of $20, and no bonuses or other elements changing this rate. For work covered by federal rules over 40 hours, at least 1.5 times the regular rate applies, with exceptions arising from regulations. The basics are explained by DOL in Fact Sheet 23.
| Element | Calculation | Gross Amount |
|---|---|---|
| 40 regular hours | 40 × 20 USD | 800 USD |
| 5 overtime hours | 5 × 30 USD | 150 USD |
| Total Due | 800 + 150 | 950 USD |
| Gross payment settled in the example | According to the payroll document | 800 USD |
| Difference | 950 − 800 | 150 USD |
Do not compare 950 USD gross with the net transfer after taxes. Do not arbitrarily add penalties and multiples of damages as certain claims. Different rates in the week, tips, bonuses, piecework, and specific industries require separate calculations. A workweek does not have to mean Monday to Sunday, and averaging two weeks does not replace the proper assessment of each week.
The Right Path: Federal or State?
The federal Wage and Hour Division enforces, among other things, the FLSA within its jurisdiction. The state agency may also consider other claims under state law. A company registered in one state, work in another, and residence in a third requires a precise description of where the work was performed. Do not choose the agency solely based on your current address.
| Path | Official Starting Point | Deadline / Limitation Worth Checking |
|---|---|---|
| Federal FLSA | WHD: How to File a Complaint | Usually 2 years, 3 for willful violations; do not delay contact |
| New York, Labor Standards | Unpaid/Withheld Wages, form LS223 | The current page indicates refusal to accept wages older than 3 years through this procedure; there are also other exclusions |
| New Jersey | NJDOL: File a Wage Complaint | State law allows claims for appropriate amounts up to 6 years back; assess the scope for the specific case |
| Illinois, Wage Payment and Collection | IDOL: Filing a Claim | In this procedure, the complaint must be filed within 1 year from the due date |
Source of deadlines: FAQ WHD, current NYSDOL page, NJ regulations, and FAQ IDOL. These are different procedures, not a single nationwide statute of limitations for all employment cases. A mere phone call, negotiation, or sending a letter to the boss should not be treated as a certain stoppage of the statute of limitations.
New York: Form and Exclusions
On the NYSDOL page, select the current form LS223 and instruction LS223.2. Describe the violation and attach the relevant summary. The agency indicates exclusions, including actual independent contractors, certain commission claims, cases subject to litigation, and other categories. Do not assume that every unpaid amount will fall under the same procedure.
If you worked in NY but are now in Poland, provide current contact information and the location of the work performed. If part of the work was in another state, separate it in the journal. When the agency's procedure does not accept the case, ask for the reason and other options; do not automatically conclude that no claim exists.
New Jersey: Reporting and Confidentiality
NJDOL recommends the online form, and the site also provides appropriate paper forms. Describe each issue precisely and provide useful contact information. The agency informs about data protection and handling employees regardless of immigration status. At the same time, it describes exceptions to confidentiality; we do not promise complete anonymity in every situation.
An anonymous report may hinder the investigation because the agency will not contact you regarding evidence, and the reporter may not have the ability to track the status. Check the rules of the anonymous channel directly before use. A confidential complaint with contact information and a completely anonymous complaint are different things.
Illinois: One-Year Deadline and Current Case Selection
IDOL informs about the preliminary case selection program started in November 2025, with limitations, including for cases concerning only disputed bonuses or severance. Check the current criteria before assuming the agency will accept every type of claim. The FAQ Filing a Claim indicates the one-year deadline for this procedure.
Gather the contract, agreements, and evidence of the claim. If the issue also involves minimum wage or overtime, check the appropriate category instead of assuming that every aspect fits into one form. Legal proceedings and other regulations may have separate rules.
Sample Message to Employer
This is an optional attempt to clarify, not a mandatory step in every case. If there are threats, risk of losing evidence, or a deadline is approaching, start with the appropriate agency or legal assistance. The text below does not contain accusations of crime or promises to waive rights.
Subject: Request to review unpaid wages for [dates]
Hello [name],
My records show that I worked [hours] during [workweek/pay period] at the agreed rate of [rate]. The attached table lists the hours and payments I have records of. I believe [amount] in gross wages remains unpaid, subject to confirmation of the payroll calculation.
Please provide the relevant pay statement, explain any differences, and confirm when the outstanding amount will be paid. Please respond in writing by [reasonable date].
Thank you,
[name]
In Polish: "Proszę o sprawdzenie rozliczenia za wskazany okres, przekazanie paska płacowego, wyjaśnienie różnic i potwierdzenie terminu zapłaty." Choose a reasonable response date; a self-imposed seven days does not become a statutory deadline. Keep a copy of the message and attachment.
Reporting to the Agency: A Complete Package in Seven Steps
- Enter the true name of the company, address of the workplace, and supervisor details that you know. Distinguish between the trade name and legal name if you can determine them.
- Provide the range of dates, type of work, and agreed rate. If the agreement was verbal, state that explicitly.
- Attach a weekly breakdown, not just the total amount without calculation.
- Explain the source of each item: schedule, message, pay stub, note, or bank confirmation.
- Describe previous attempts to clarify and the actual response from the company.
- Disclose any previous proceedings regarding the same money. Do not hide a parallel court case.
- Keep the sent version, case number, and response calendar. Receive correspondence and update contact information.
Retaliation and Immigration Status
WHD informs that it enforces regulations regardless of immigration status, describes confidentiality with exceptions, and protection against retaliation. This does not mean a general guarantee of immigration safety for every person in every case. For specific concerns, consult worker and immigration assistance without disclosing your documents in public comments.
If your hours were reduced, you were threatened, or terminated after seeking payment, record the date, words, people present, and related correspondence. Report this thread to the appropriate institution. Do not publish private information about your supervisor on social media as a way to force payment.
Settlement, Partial Payment, and Next Steps
Record the receipt of partial payment with the date and description of the period it pertains to. Do not dismiss the entire claim without checking the calculation. A document for "full and final settlement," a release of claims, or a check with a conditional description may have legal consequences – read them and consult if necessary before acceptance. This guide does not assess the binding significance of a specific settlement.
If the company claims it has no money, keep that response, but do not assume that the obligation to pay disappears. Bankruptcy, business closure, and liability of other entities require separate analysis. We do not provide a universal timeline for payment after a complaint: it depends on evidence, proceedings, and enforcement possibilities.
FAQ
Can I ask about a wage claim without a written contract?
Yes, the lack of a paper contract should not prevent you from presenting the facts to the agency. Keep other evidence of agreements and work.
Does cash payment negate rights?
The method of payment does not determine the status. Document amounts and dates without adding fictitious receipts.
Do I have one year for each claim in the USA?
No. The one-year deadline in the table pertains to the specified Illinois procedure; other claims and paths have different rules.
Can I count overtime after eight hours a day?
Do not accept this rule as nationwide. Our example pertains to the federal workweek and an employee covered by the appropriate protection.
Does reporting guarantee anonymity?
Not in every situation. Read the rules of the specific institution, including exceptions and limitations for anonymous complaints.
Will the agency also recover promised bonuses?
It depends on the state, documents, and current jurisdiction. NY and Illinois indicate limitations that need to be checked.
