Renovation is one of the most common sources of consumer disputes. The crew disappears after the advance payment, deadlines are postponed, and "minor corrections" drag on for months. However, the law provides you with strong tools: 14 days to withdraw from a contract signed at your home, warranty for the work performed, and the possibility of completing the renovation with another crew at the expense of the one that failed. Below, we describe how to hire a contractor wisely (contract, deposit, schedule), what to do when something goes wrong, what VAT should be on the invoice, what can be rebuilt without the office, and where to get free assistance.
Last verification: October 23, 2026. This is informational material and not legal advice. In case of a dispute over a large amount, consult a lawyer or a consumer advocate, as courts assess renovation cases very individually.
In Brief
- Renovation for consumers is usually a contract for work (art. 627 of the Civil Code), and for larger projects according to a design, it may be a construction contract (art. 647 of the Civil Code). An oral contract is also binding, but you are realistically protected only by a written one, with a scope, cost estimate, and deadlines.
- A contract signed at your home is a contract concluded outside the business premises. You have 14 days to withdraw without giving a reason, and in the case of an unannounced visit by the contractor, 30 days. Without being informed about this right, the deadline extends by 12 months.
- Is the crew late or incompetent? You can withdraw even before the deadline (art. 635 of the Civil Code) or after an ineffective request have corrections done by another crew at the contractor's expense (art. 636 of the Civil Code).
- The contractor is liable for defects in the work performed under warranty (art. 638 of the Civil Code). The basic term is 2 years. For defects in real estate, the code provides for 5 years, but whether this applies to apartment renovations can be disputed.
- Fixed price is fixed: the contractor cannot demand an increase in the fixed price just because more work turned out to be necessary (art. 632 of the Civil Code).
- A renovation service in an apartment up to 150 m² or in a house up to 300 m² is subject to VAT 8%. Materials purchased separately in a store have 23%.
- Work on load-bearing walls and in common parts of the building requires a project, construction formalities, and the consent of the community.
- Free assistance: district (municipal) consumer advocate and consumer hotline 801 440 220 or 222 66 76 76.
Before You Sign: Choosing a Crew and Contract
- Check the Contractor
In CEIDG or KRS, you can see if the company exists and how long it has been operating. Review opinions from several sources, photos of completed projects, and ask for contact with previous clients. Inquire about the liability insurance. If the crew floods a neighbor and has no insurance or assets, the problem may fall on you.
- Written Contract with Details
Specify the scope of work (preferably as an attachment with a cost estimate item by item), who buys the materials and of what quality, deadlines for stages, type of remuneration (fixed price or cost estimate), payments by stages, contractual penalties for delays, and how to report defects. An oral contract is also valid, but in a dispute, word stands against word. A construction contract "should be confirmed in writing" (art. 648 § 1 of the Civil Code).
- Deposit Instead of an Advance Payment
A deposit (art. 394 of the Civil Code) works both ways. If the contractor does not perform the contract, you can withdraw from it without an additional deadline and demand double the deposit. An advance payment simply returns. It is reasonable not to pay more than 10–20% upfront, and to give subsequent installments only after receiving completed stages.
- Fixed Price or Cost Estimate?
Fixed price means a set price. The contractor cannot demand more, even if it was impossible to foresee the amount of work at the time of signing (art. 632 § 1 of the Civil Code). Only a court can exceptionally increase the fixed price if an unpredictable change in circumstances threatens the contractor with severe loss. Cost estimate is flexible, so keep an eye on items and unit prices. If the contractor prepared the list of works, they can only demand additional payments for extra work if they could not foresee it despite due diligence, and for work done without your consent, they are entitled to nothing (art. 630 of the Civil Code).
- Who Really Works?
In a construction contract, you are jointly liable with the contractor for paying subcontractors whose scope of work was reported to you before the work began, unless you file an objection within 30 days (art. 647¹ of the Civil Code). So ask who will be working on the site, and respond to written notifications.
- Protocols and Photos
Write a handover protocol for the apartment (meter readings, existing defects), protocols for receiving stages, and take photos before and after. Such documentation most often resolves disputes.
Check If You Can Withdraw from the Contract
Answer a few questions, and the flowchart will indicate which deadline applies to you and where to find details.
Can You Withdraw from the Contract with the Renovation Crew?
Where did you conclude the contract?
Is this an urgent repair for which you called the specialist yourself, something made to your specifications, or a service fully performed with your explicit consent?
Did the contractor inform you about the right to withdraw?
Did the contractor inform you about the right to withdraw?
The right to withdraw without giving a reason does not apply to you
This mode only applies to contracts concluded outside the business premises or at a distance. When the crew fails, you use the Civil Code: withdrawal in case of significant delay, request for corrections, warranty. See the section "The Crew Fails: Your Rights under the Civil Code".
In this regard, you usually cannot withdraw
Exceptions include urgent repairs in the scope you requested, items made to your specifications, and services fully performed with your explicit consent after being informed about the loss of this right. You can withdraw from additional services and goods added "on the occasion" of an urgent repair. If in doubt, ask a consumer advocate.
You have 14 days to withdraw
The deadline counts from the day of concluding the contract. It is enough to send a statement before it expires, e.g., on the contractor's form. If the work started earlier at your explicit request, you will pay proportionally for the part completed.
You have 30 days to withdraw
In the case of an unannounced visit by the contractor to your home, the deadline is 30 days. In this case, exceptions for fully performed services or items made to specifications do not apply.
The right to withdraw lasts even over a year
If you were not informed about the right to withdraw, it expires only 12 months after the usual deadline of 14 or 30 days. If the contractor informs you later, from that moment a new deadline of 14 or 30 days begins.
Contract Signed at Your Home: 14 Days to Withdraw
A contract concluded outside the business premises (e.g., the contractor signs it with you at your apartment) or at a distance is subject to the Consumer Rights Act (t.j. Dz.U. 2026 poz. 1244). The law recognizes a distance contract as one concluded by the company within an organized system, without a meeting of the parties (art. 2 pkt 1). Individual arrangements made by phone with a specialist you later meet do not always meet this condition.
- 14 days to withdraw without giving a reason (art. 27 ust. 1). For services, the deadline runs from the day of concluding the contract (art. 28). You can submit a statement using the form from Annex No. 2 to the Act, and sending it is sufficient to meet the deadline (art. 30).
- 30 days if the contract was concluded during an unannounced visit by the entrepreneur to your home or during a trip (art. 27 ust. 2). This is a typical situation for "professionals" going door to door.
- No information about the right to withdraw? The right expires only 12 months after the usual deadline (art. 29 ust. 1). If the company informs you later, from that day you have again 14 or 30 days (art. 29 ust. 2).
- Exceptions (art. 38 ust. 1): you cannot withdraw from urgent repairs or maintenance for which you called the specialist, but only in the scope you requested. Withdrawal applies to additional services and goods other than necessary parts (point 8). You also cannot withdraw from a service fully performed with your explicit prior consent if you were informed that you would lose this right (point 1), nor from items made according to your specifications, e.g., custom furniture (point 3).
- In the case of an unannounced visit, exceptions for fully performed services, custom items, and several others do not apply (art. 38 ust. 2).
- Work started before the deadline at your explicit request? Upon withdrawal, you pay proportionally for the part completed, calculated according to the agreed price, and if this is excessive, according to market value (art. 35).
- After withdrawal, the company has 14 days to refund your payments (art. 32 ust. 1).
The Crew Fails: Your Rights under the Civil Code
The same rules apply to a construction contract, as art. 656 § 1 of the Civil Code refers to delays, defective performance, warranty, and withdrawal to the provisions on work.
| Problem | Your Right | Basis |
|---|---|---|
| Delay so significant that the deadline cannot be met | withdrawal from the contract even before the final deadline, without setting an additional deadline | art. 635 of the Civil Code |
| Work performed defectively or not in accordance with the contract | request to change the method of execution with an appropriate deadline, and after its ineffective expiration withdrawal or entrusting corrections or completion to another person at the contractor's cost and risk | art. 636 § 1 of the Civil Code |
| Fixed price "increases during the process" | you can refuse to pay extra | art. 632 § 1 of the Civil Code |
| Defects revealed after acceptance | warranty: demand repair, price reduction, and in the case of a significant defect, withdrawal | art. 638 in conjunction with art. 556 et seq. of the Civil Code |
| The contractor did not perform the contract after taking the deposit | withdrawal and demand double the deposit | art. 394 § 1 of the Civil Code |
Claims from a contract for work expire after 2 years from the delivery of the work, and if the work was not delivered, from the day it was supposed to be delivered (art. 646 of the Civil Code). Do not postpone disputes.
Warranty for Renovation Defects
- What regulations? Renovating an apartment is a service whose effect is not a movable item. Therefore, warranty provisions from the Civil Code apply accordingly (art. 638 § 1 in conjunction with art. 556 et seq.). Consumer regulations on the non-conformity of goods with the contract from the Consumer Rights Act apply to works that are goods (art. 43a), e.g., custom furniture from a carpenter. There, you first demand repair or replacement, and the company is liable for non-conformity revealed within 2 years (art. 43c and 43d).
- Deadlines: the contractor is liable for a physical defect identified within 2 years, and for defects in real estate 5 years (art. 568 § 1). Whether a defect in apartment renovation is considered a "defect in real estate" can be disputed, so it is safer to count on 2 years and report defects immediately. A claim for defect removal expires one year from its identification, but for consumers, not earlier than at the end of these 2 or 5 years (art. 568 § 2).
- What can you demand: removal of the defect, price reduction, or, in the case of a significant defect, withdrawal from the contract (you cannot withdraw for a minor defect, art. 560 § 4). The contractor can block the reduction or withdrawal if they promptly and without excessive inconvenience remove the defect. They cannot do this if they have already repaired it once or ignored your request (art. 560 § 1).
- Your material: the contractor is not liable for a defect that arose from a cause inherent in the material supplied by you (art. 638 § 1 sentence 2). By purchasing "your" tiles, you take on their quality.
- Fraud: if the contractor fraudulently concealed a defect, the expiration of the deadline for its identification does not deprive you of your rights under the warranty (art. 568 § 6).
- Guarantee is a voluntary addition from the contractor or manufacturer. It does not replace the warranty.
VAT on the Invoice: 8% or 23%
- Renovation service (renovation, modernization, thermomodernization, reconstruction) in a residential unit up to 150 m² or in a single-family house up to 300 m² is subject to a rate of 8% (art. 41 ust. 2 and 12–12b in conjunction with art. 146ef of the VAT Act, t.j. Dz.U. 2026 poz. 1263). For larger areas, 8% applies only to the part corresponding to the limit (art. 41 ust. 12c).
- Materials that the contractor uses and includes in the service price are usually accounted for together with it at the service rate. For maintenance work alone, 8% does not apply if the value of goods exceeds 50% of the taxable base (art. 41 ust. 12e).
- Materials purchased independently in a store have 23%.
- An invoice is also your proof in a dispute and when claiming warranty. "Without an invoice, it's cheaper" means no record of the transaction.
- There is no general renovation relief in PIT, nor is there a VAT refund for materials.
Subsidies and Reliefs for Renovation in 2026
| Instrument | For Whom | How Much and on What Terms |
|---|---|---|
| Thermomodernization relief (art. 26h of the PIT Act) | owners and co-owners of single-family residential buildings; apartments in blocks are excluded | deduction from the taxable base up to 53,000 PLN per taxpayer for all projects; the project must be completed within 3 consecutive years from the end of the year of the first expenditure; only based on invoices from an active VAT taxpayer |
| Clean Air | individuals who have been owners or co-owners of a single-family house (or a unit in such a house with a separate land and mortgage register) for at least 3 years; exceptions apply in case of inheritance and adverse possession, and in some cases, one year is sufficient | three levels of funding (up to 40%, 70%, and 100% of eligible costs); annual income threshold for the basic level 135,000 PLN; for example, up to 170,100 PLN at the highest level; mandatory energy audit; hotline 22 340 40 80 |
- From January 1, 2025, gas or oil boilers are no longer included in the list of expenditures for thermomodernization relief. Instead, there are, among others, energy and heat storage systems, energy management systems, and heat nodes (regulation, t.j. Dz.U. 2025 poz. 1128). Clean Air also does not subsidize gas and oil boilers.
- From July 20, 2026, changes apply to new applications in Clean Air: higher rates for insulation and joinery by 10%, 180 days instead of 120 for work covered by an advance, and more lenient ownership period rules.
- You cannot deduct the same expenditure in the relief if it was financed by a subsidy from environmental protection funds (art. 26h ust. 5).
- For a regular apartment renovation in a block, the main benefit left from this list is VAT 8% on the service.
What Can Be Renovated Without the Office, and What Requires Formalities
| Work | Formalities (Construction Law, t.j. Dz.U. 2026 poz. 524) |
|---|---|
| Painting, smoothing, flooring, replacing fixtures, furniture, interior doors | none |
| Renovation of the unit, also with newer materials, without interfering with structural elements and external partitions of the building | none (art. 29 ust. 4 pkt 2 lit. a) |
| Installing installations inside the building, except for gas | none (art. 29 ust. 4 pkt 3 lit. d) |
| Reconstruction within the unit without violating structural elements and external partitions (e.g., moving a partition wall) | none (art. 29 ust. 4 pkt 1 lit. a), but first, a constructor should confirm that the wall is not load-bearing) |
| Gas installation inside and outside the used building | notification (art. 29 ust. 3 pkt 3 lit. d) and the contractor with appropriate qualifications |
| Work on load-bearing walls, other structural elements, or external partitions in a block | project and building permit (not included in the exemption catalog from art. 29) and consent from the community or cooperative |
- Common parts of the building (structure, facade, installation risers): reconstruction of common property is an action exceeding ordinary management, so a resolution of the owners is needed in the community (art. 22 ust. 2 and 3 pkt 5 of the Act on Ownership of Premises). In a cooperative, check the regulations. The manager will usually ask for a project and a constructor's opinion.
- Working hours: there is no single nationwide law that establishes them. The regulations of communities and cooperatives apply, and disturbing peace or nighttime rest with noise can be an offense (art. 51 of the Offenses Code). A note in the stairwell with apologies and the end date of the work usually works better than a war with neighbors.
Remote Renovation for the Polish Diaspora
- Assign stage inspections to a trusted person or inspector. Pay only after receiving a handover protocol with photos and recordings.
- Sign the contract and annexes electronically or through a proxy. Plan foreign transfers with a buffer, as banks may verify them additionally.
- A camera in the apartment during the renovation is possible in your own unit, but inform the crew about it.
- Immediately save bills and invoices in the cloud. They will be useful for warranty claims and future sales.
Common Mistakes by Clients
- Large advance payment without a contract is a classic scenario for the crew disappearing. A deposit and payments by stages are better.
- Oral contract "on trust": without a scope and deadlines, you have nothing to enforce.
- Payment in full before defects are removed. Retain 10–15% until final acceptance.
- No written request. Rights from art. 635 and 636 of the Civil Code are activated by writing (email or SMS also leaves a trace), not by a quarrel.
- Missed 14 days to withdraw from a contract concluded at home or unawareness that lack of information extends this deadline by a year.
- Demolishing a wall "because it's definitely a partition" without a constructor and formalities risks building supervision orders and liability to neighbors.
- "Without an invoice, it's cheaper": you save on VAT, but lose evidence.
- Postponing a dispute. The two-year statute of limitations from art. 646 of the Civil Code passes faster than you think.
What Is Certain and What Depends on the Case
Certain, as it follows directly from the regulations: deadlines for withdrawing from contracts concluded outside the business premises, rules for fixed prices, substitute performance at the contractor's expense, two-year statute of limitations from the contract for work, VAT rate of 8% within the area limits, and the limit of thermomodernization relief. It depends on the specific case: whether the contract is for work or construction, whether the defect is significant, whether to apply the 5-year warranty period for real estate for apartment renovation, and what local community regulations say. Two common myths: "oral contracts do not count" (they bind, but are harder to prove) and "once I paid, I can't do anything" (warranty applies even after payment).
Frequently Asked Questions
I signed a contract with a contractor at my apartment and regret it. What can I do?
You can withdraw without giving a reason within 14 days, and if the visit was unannounced, within 30 days. If no one informed you about this right, the deadline extends by 12 months. Send a statement before the deadline expires. An email is sufficient, but a registered letter provides better proof. If the work has already started at your explicit request, you will only pay for the part completed.
The crew took an advance and is not answering the phone. What should I do?
Send a written request to start work with a deadline (e.g., 7 days) and a warning of withdrawal. After it expires, withdraw from the contract in writing and demand a refund, and for the deposit, demand double its amount. Then you can turn to a consumer advocate or file a lawsuit. The fee for the lawsuit is 30 PLN for amounts up to 500 PLN, 100 PLN for amounts up to 1500 PLN, and 200 PLN for amounts up to 4000 PLN. If the company "serially" disappears after advances, consider reporting suspected fraud.
Six months after the renovation, tiles are falling off. Can I demand a repair?
Yes, under warranty. Report the defect in writing and set a deadline for repair. If the contractor does not respond, you can demand a price reduction, withdraw from the contract in case of a significant defect, or have another company repair it and claim costs. Six months falls within the two-year deadline from art. 568 § 1 of the Civil Code. One exception: if you bought the tiles yourself and they are defective, the contractor is not responsible for them.
The contractor demands an additional payment for the fixed price halfway through the work. Do I have to pay?
No. The fixed remuneration cannot be increased, even if more work turned out to be necessary (art. 632 § 1 of the Civil Code). The exception is a court decision when an unpredictable change in circumstances threatens the contractor with severe loss. You can refuse additional payments "because everything has become more expensive".
Can I demolish a partition wall without notification?
A wall that is truly not load-bearing can be demolished within your own unit. This is a reconstruction that does not violate structural elements (art. 29 ust. 4 pkt 1 lit. a of the Construction Law). Leave the assessment of whether the wall is load-bearing to a constructor, and check the regulations in the community or cooperative, as the manager may require notification. A load-bearing wall requires a project, building permit, and community consent.
Where can I get free assistance in a dispute with the contractor?
From the district (municipal) consumer advocate. They provide free advice, act on your behalf with companies, and can file a lawsuit on your behalf (art. 39 and 42 of the Act on Competition and Consumer Protection). The consumer hotline 801 440 220 or 222 66 76 76 (business days 10:00–18:00), email advice through dlakonsumentow.pl, and the Trade Inspection, which has mediation and permanent arbitration courts, can also help. You can find a search engine for advocates on the UOKiK website.
