After Brexit, EU citizens (including Poles) need EU Settlement Scheme status for legal residence in the UK. This guide explains the difference between Settled and Pre-settled Status and what to do if you missed the deadline.

Settled vs Pre-settled Status

  • Settled Status (Indefinite Leave to Remain) – for individuals who have lived in the UK continuously for over 5 years. Full rights: no residency limits, entitlement to benefits, pathway to British citizenship.
  • Pre-settled Status – for individuals who have lived in the UK for less than 5 years (before December 31, 2020). Temporary status for 5 years – then you must apply for Settled Status.

Application Deadline

The official deadline was June 30, 2021. However, the Home Office still accepts late applications if "reasonable grounds" can be demonstrated – e.g., illness, lack of knowledge, caring for others, dependent status.

How to Check Your Status

  1. Go to gov.uk/view-prove-immigration-status
  2. Log in with your application details (passport + date of birth + verification code)
  3. You will see your current status, validity dates, and options to share your status with an employer/landlord

Step by Step: Online Application

  1. Download the "EU Exit: ID Document Check" app (Android/iOS) or go to a scanning centre
  2. Scan your Polish biometric passport
  3. Complete the online form at gov.uk/apply-for-eu-settlement
  4. Attach evidence of residence in the UK (rental agreements, P60, bank statements, NHS letters)
  5. Wait for a decision – usually 5 working days, sometimes up to 6 months

    • Rental agreements / mortgage
    • P60 / P45 / payslips
    • Bank statements with UK address

How Long It Takes

  • Standard time: 5 working days to 1 month

What If You Missed the Deadline

You can still apply with "reasonable grounds for delay" – acceptable categories include:

  • Lack of knowledge about the requirement (e.g., children, elderly, minors in foster care)
  • Illness or disability
  • Difficult home situation (domestic violence, control)
  • Caring for other family members
  • Lack of technical access (smartphone, internet)

Submit your application as soon as possible and include a written explanation of the reason for the delay.

Common Mistakes

  • Not reporting changes in details (address, surname after marriage)
  • Exceeding 5 years without applying for Settled Status (Pre-settled expires)
  • Leaving the UK for over 6 months during Pre-settled Status (may invalidate status)
  • Confusing status with the right to work – Pre-settled gives the right to work

What Next After Settled Status

After 12 months of Settled Status, you can apply for British citizenship (if you meet the requirements: Life in the UK Test, English proficiency B1+, character, physical presence).
