Legal Status and Main Principles

What to Do After Receiving a Letter

When a vehicle has been registered by a device, the authority may summon the owner or holder to indicate who was entrusted with the vehicle for driving or use during a specified time. The response should refer to the specific summons and the actual state of affairs. In a company, the owner, lessee, and actual user may be different entities, so before sending a response, it is necessary to determine who received the summons and what the authority is requesting.

Do not assume that every case automatically results in a fine for the owner or that it is sufficient to provide any name. The responsibility for failing to indicate a person and the consequences of an incorrect response depend on the circumstances, the basis of the summons, and the course of the proceedings. In case of a dispute, review the instructions and consult the letter with a lawyer.

What the UD263 Bill Proposes

The bill aims to change the system of automatic traffic supervision. The published government description includes, among other things, clarification of the driver's data and confirmation by the indicated person of driving and the decision to accept or refuse the fine. The description in the government's work list and later versions of the documents may differ, so the specific version of the bill should be checked before applying it in company plans. In the discussed versions of the bill, administrative fees for the owner or holder appeared if the required confirmation by the driver does not occur. Details of amounts, exceptions, deadlines, and potential fee reductions depend on the version of the text and further legislative work. As of the date of the check, do not issue a summons to the employee based solely on the draft or assume that the date of entry into force provided in it is already certain.

What is Worth Doing in the Company

  • Determine who is responsible for receiving letters and monitoring response deadlines.
  • Maintain a clear record of vehicle handover: vehicle number, user, date, and time. Adjust the scope of data and retention period to the purpose and data protection regulations.
  • Describe the rules for informing the company about summons and checking documents. Do not force the employee to provide false statements.
  • Do not automatically deduct the amount from the salary. The Labor Code limits deductions; consent for other deductions and potential employee liability require separate legal assessment.

Letter After Photo: What to Check Step by Step

  1. Check who the addressee of the letter is, which vehicle and time it concerns, and which authority sent it. Read the deadline and instructions.
  2. Determine based on the documents who was entrusted with the vehicle at that time. In the case of leasing or rental, the owner, holder, and user do not have to be the same person.
  3. Respond according to the facts. Keep a copy of the response and confirmation of its sending or submission.
  4. If you cannot establish the facts or dispute the summons, do not guess. Present the documents to a lawyer who will assess the situation based on the specific letter.

Driver's Fine vs. Owner's Responsibility

A fine for the driver's offense and the responsibility related to failing to indicate the person to whom the vehicle was entrusted concern different issues. The bill additionally introduces the concept of an administrative fee; it should not be presented as an already applicable fine. Amounts, exceptions, and the appeal procedure need to be checked in the final text if the law is passed.

Example: a car is assigned to a service team, but on Monday, it could have been taken over by another employee. The mere list of regular users is not sufficient to determine who was entrusted with the car at the time indicated in the letter. The handover register, duty schedules, and rental documents can help reconstruct the facts, but their absence does not justify indicating a random person.

Documents and Personal Data in Vehicle Records

Determine the purpose of maintaining the register and do not record more data than necessary to manage the fleet and respond to summons. Specify the individuals with access, the rules for correcting errors, and the retention period. Consult data protection and monitoring vehicle usage rules with the person responsible for GDPR.
