Health Insurance in Poland When Living Abroad: NFZ, EKUZ, and Treatment Without Insurance (2026)

The right to NFZ expires 30 days after losing eligibility, and living in the USA places you outside the system by law; voluntary insurance costs 845.67 PLN/month with residency traps and additional fees up to 18,792 PLN, differences in returning from the EU vs. the USA (S1), EKUZ, the myth of 'retirement to a Polish account = NFZ', and what uninsured patients can expect in hospitals.

“I am a Polish citizen, I have paid contributions for years – I must have NFZ, right?” Unfortunately: most often, no. Polish health insurance does not follow citizenship or sentiment – it expires 30 days after losing eligibility (e.g., Polish employment), and a person permanently residing in the USA or Canada is completely outside the system. This guide explains based on the current text of the law (Dz.U. 2025 poz. 1461) who really has the right to NFZ, how voluntary insurance works (845.67 PLN per month – with residency traps and additional fees reaching 18,792 PLN), what a ZUS pensioner living in America is entitled to, how returning from London differs from returning from Chicago – and debunks several myths circulating in Polish community groups.

When You Lose NFZ After Leaving

  • 30 days after losing eligibility: the right to benefits ceases 30 days after the expiration of the insurance obligation (art. 67 ust. 4) – this also applies to registered family members. Graduates have longer: 6 months after high school, 4 months after university.
  • Living across the ocean excludes you from the system: according to art. 3 ust. 1 of the law, a Polish citizen can be “insured” generally only if residing in an EU/EFTA country or the United Kingdom (exception: individuals living further away but still covered by Polish pension and disability insurance, e.g., working for a Polish payer). A Pole permanently residing in the USA, Canada, or Australia is therefore outside the Polish system by law – regardless of registration and citizenship.

Voluntary NFZ Insurance: How It Works and Where the Traps Are

A person without eligibility for insurance can sign a voluntary insurance agreement with the NFZ branch. The contribution in Q3 2026: 845.67 PLN per month (9% of the average salary in the enterprise sector – updated quarterly). Three things that most guides do not mention:

Trap No. 1: You Must Reside in Poland

A condition of the agreement is residence on the territory of the Republic of Poland (art. 68 ust. 1) – a Pole living in Chicago cannot “pay for NFZ from America” for visits. Voluntary insurance is an option only after actual return.

Trap No. 2: Additional Fee for Break – Up to 18,792 PLN

In case of a break in insurance longer than 3 months, the NFZ charges a one-time additional fee (art. 68 ust. 8), in Q3 2026: break of 3 months–1 year – 1,879.27 PLN; 1–2 years – 4,698.16 PLN; 2–5 years – 9,396.33 PLN; 5–10 years – 14,094.50 PLN; over 10 years – 18,792.66 PLN. In justified cases, the branch director may spread it over a maximum of 12 installments or waive it – a motivated application must be submitted.

Trap No. 3: American Insurance Does Not Shorten the Break

Periods of insurance in the EU/EFTA and the UK are documented with form S-041 (formerly E-104) and count as Polish. For insurances from the USA, there is no such mechanism – the Polish-American social security agreement does not cover health. In practice, 15 years of solid employee insurance in Illinois counts as 15 years of break (200% fee). Before signing the agreement, it is advisable to confirm your situation with the NFZ branch.

Formalities: application to the NFZ branch according to residence → agreement → ZUS ZZA registration (code 24 10 XX); family members (spouse, children) can be added free of charge within 7 days.

The practical order after returning from the USA: if you have a spouse insured in Poland – register as a family member (free, immediate); if not – registration at the labor office gives you eligibility from the day you obtain unemployed status. EKUZ: Who Is It For and How Long

The EKUZ card entitles you to necessary, unplanned public treatment in the EU/EFTA and in the United Kingdom – but it is issued by the country where you are insured. A person insured only in the USA will not receive EKUZ anywhere. For those insured in Poland, current validity periods are: retirees of retirement age – 20 years; younger retirees and uninsured children up to 18 years – 5 years; workers and entrepreneurs – 3 years; disability pensioners, adult family members, students – 18 months; contractors – 6 months; unemployed – 2 months.

ZUS Pensioner in America: The Myth of the Polish Bank Account

A popular myth from Polish community groups: “Have your ZUS pension transferred to a Polish account, and you will have NFZ.” This is not true under the law: the status of being insured is determined by residence (art. 3), not by account number. The bank as a health insurance contribution payer applies to foreign pensions entering Poland (art. 75) – not to a Polish ZUS pension paid to a person living in the USA. If ZUS has not been notified of the departure and deducts contributions, there may be a discrepancy between the eWUŚ system and the actual legal state – which poses a risk of contesting benefits, not a guarantee of treatment.

A ZUS pensioner living in the USA is practically uninsured during visits to Poland (health contributions are not deducted – the pension comes without it, as described in the guide on pension from the USA and Poland). Medicare does not work outside the USA. Real options during visits: travel insurance covering medical expenses (see below) and private visits for cash (single specialist consultation approx. 250–350 PLN). Retirees living in the EU/UK have it better: they remain insured in Poland, receive S1 and EKUZ for 20 years.

Treatment Without Insurance: What Really Happens

  • In an emergency, everyone receives help immediately (art. 19 of the law), and ambulance and emergency medical services are free regardless of status – but for treatment in the emergency room and hospital stay, a person without the right to benefits will later receive a bill according to the hospital's price list (approximately: emergency room 150–400 PLN, hospital stay from about 120 PLN to thousands in intensive care).   • Children under 18 with Polish citizenship are entitled to benefits without the condition of residence in Poland (art. 2 ust. 1 pkt 3 – the residency condition applies only to foreigners). This is a little-known, important provision for the Polish community – although in practice, facilities may be unaware of this nuance, so it is advisable to have proof of the child's citizenship with you.
  • Pregnant women, during childbirth, and postpartum – note, here it is the opposite: the law requires Polish citizenship and residence in Poland (art. 2 ust. 1 pkt 4). The myth “every Polish woman in pregnancy receives free treatment in Poland” is untrue for residents of the USA.
  • Poor individuals living in Poland can obtain 90 days of entitlement to benefits by decision of the mayor (art. 54) – this, however, requires documented residence in the country and income criteria, so a visitor from abroad will not be covered.

Insurance During Visits – What to Remember

  • Regular Polish “tourist insurance” works the other way around (for those leaving Poland). Living in the USA, look for a visitor/travel medical policy purchased in the USA covering Poland or a Polish product “medical expenses for people coming to Poland” (offered by major insurers). Check the sum for medical expenses, medical transport, and surcharges for chronic illnesses.
  • Poland and the USA have no mutual funding agreement for treatment – without a policy, you pay out of pocket.
  • Readers from the United Kingdom: the free GHIC card covers necessary public treatment in Poland – obtain it before traveling.

Context 2026: the reform of the health insurance contribution for entrepreneurs was vetoed in May 2025 and is dead – the rules for voluntary insurance remain unchanged, and the contribution increases quarterly with the average salary. The NFZ is struggling with a financial gap (the plan for 2026 is about 201 billion PLN for benefits with estimated deficits counted in several to dozens of billions), which practically means longer waiting times – all the more reason to sort out your status before returning and to have insurance for visits.
