What is an unrealized benefit
An unrealized benefit is a benefit from ZUS that was owed to a deceased person but was not paid out before their death. This most often concerns:
- pension,
- disability pension,
- family pension,
- supplements to benefits,
- benefits granted by ZUS that were not paid out,
- benefits for which the deceased submitted an application but died before a decision was made (provided they met the conditions).
The legal basis is Article 136 of the Act of December 17, 1998, on pensions and annuities from the Social Insurance Fund. The rules are also described by ZUS on the zus.pl — unrealized benefits page.
Most important information
If a close person has died and did not receive the due benefit from ZUS, the eligible family can receive this money — but only if they submit the appropriate application.
The application must be submitted within 12 months from the date of death. After this period, the right to the benefit generally expires.
Media sometimes report specific amounts (for example, “up to 4000 PLN”). In reality, there is no fixed limit — the amount paid corresponds to the amount of the unpaid benefit of the deceased.
When does the right to an unrealized benefit arise
Example 1 — pension for the month of death
Mr. Jan received his pension on the 20th of each month. He died on June 15, before the pension for June was paid. The family can submit a request for the payment of this pension as an unrealized benefit.
Example 2 — application without a decision
Ms. Anna submitted an application for a pension. ZUS did not manage to issue a decision, and Ms. Anna died. If she met the conditions for the pension, the eligible family can receive the due benefit.
Example 3 — decision issued, no payment
ZUS granted a pension by decision, the transfer was prepared, but the pensioner died before the payment. The family can still apply for this money.
Who can receive the money
Article 136 of the Act establishes the exact order of eligible persons. ZUS pays the unrealized benefit in the following order.
Group one
Spouse and children who lived in a common household with the deceased.
Group two
If there are no persons from the first group — spouse and children who did not live in a common household with the deceased.
Group three
If there is no one from the first two groups — other family members entitled to a family pension (for example, parents, grandchildren, siblings) or persons who were dependent on the deceased.
If there are several eligible persons
If several persons from the same group apply, the benefit is divided equally among them.

Is it necessary to conduct inheritance proceedings
No. This is one of the biggest misunderstandings. An unrealized benefit is not a regular component of the inheritance. It is not determined by:
- wills,
- notaries,
- court decisions on inheritance acquisition.
The right to payment is determined by the provisions of the Act on pensions and annuities, not inheritance law.
12-month deadline
This is the most important part of the entire procedure. If the application is not submitted within 12 months from the death of the eligible person, the right to the money generally expires. An exception is when the eligible person submitted an application for the benefit before this deadline.
It does not matter that the family was unaware of such a benefit. Ignorance of the regulations does not extend the deadline, so it is advisable to act quickly.
ENS form
You must submit the ENS form — “Application for the payment of unrealized benefits.” The form can be downloaded from the ZUS website: ENS form (PDF, zus.pl) or submitted electronically through the ZUS Electronic Services Platform.
What documents to prepare
The following documents are usually required:
- ENS form,
- death certificate,
- marriage certificate (if the spouse is applying),
- birth certificate of the child (if the child is applying),
- document confirming the common household (if required),
- documents confirming dependency on the deceased (if required).
ZUS may request additional documents depending on the situation.
Where to submit the application
- in person at a ZUS office,
- by mail,
- through an authorized representative,
- electronically through the ZUS Electronic Services Platform — service through PUE/eZUS,
- from abroad — also through the Polish consulate.
How much time does ZUS have
ZUS should issue a decision within 30 days after clarifying all circumstances of the case. If additional documents need to be provided, the deadline may be extended.
Can you appeal
Yes. You can appeal ZUS's decision to the Labor and Social Security Court. The appeal is submitted through ZUS, within one month from the date of delivery of the decision.
Is the benefit taxable
Yes. ZUS withholds an advance on income tax, and after the end of the tax year, it sends a PIT-11 information form, which is included in the annual settlement.
Common mistakes
- Waiting for contact from ZUS. ZUS is not obliged to inform every family about the possibility of receiving money.
- Believing that the money always automatically lapses. This is not always the case — an application must be submitted.
- Assuming that an inheritance proceeding is sufficient. The ENS form must be submitted separately.
- Exceeding the 12-month deadline. After this time, the claim generally expires.
- Confusing ENS with funeral benefits. These are two different benefits — one can be entitled to both.
What the ENS form does NOT cover
The ENS form does not pertain to the following matters, which have separate regulations and procedures:
- funeral benefit,
- family pension,
- funds from OFE,
- funds from the sub-account in ZUS,
- money in the deceased's bank account,
- life insurance policies.
Frequently asked questions
Can I receive a pension after my deceased mother
If the pension was due to her but was not paid, and you are an eligible person under the law and submit the ENS form on time — yes.
Do I have to be an heir
Not always. The right to an unrealized benefit does not depend solely on inheritance law.
Can I submit an application while living abroad
Yes. This can be done electronically through PUE/eZUS or through the Polish consulate.
Can I submit an application after two years
Generally no. The deadline is 12 months from the date of death.
Will ZUS automatically transfer the money to the family
Most often no. The family must submit the appropriate application (ENS form).
Checklist
- Establish the date of death.
- Check if the deceased was receiving a pension or annuity.
- Check if they had submitted an application to ZUS.
- Download the ENS form.
- Prepare the required documents (death certificate and others).
- Submit the application before the 12-month deadline.
- Keep confirmation of document submission.
- In case of refusal, check the possibility of appealing within a month.
